REGULATION OF THE MINISTER OF FINANCE

CONCERNING
DIRECTION TO INCREASE DISCIPLINE OF CIVIL GOVERNMENT EMPLOYEE IN THE MINISTRY OF FINANCE
MINISTER OF FINANCE,
Considering:
- a. that to implement clean, prestige and responsible government officer and to increase competence, transparency and integrity, it is necessary to increase discipline of Civil Government Employee in Ministry of Finance;
- b. that effort to increase discipline of Civil Government Employee in Ministry of Finance, it is a necessary Direction to Increase Discipline of Civil Government Employee in Ministry of Finance;
- c. that based on consideration as described in paragraphs a and b, it is necessary to stipulate Regulation of the Minister of Finance concerning Direction to Increase Discipline of Civil Government Employee in Ministry of Finance;
In view of:
- 1. Law No. 8/1974 concerning Principles of Employment (Statute Book of the Republic of Indonesia Year 1974 No. 55, Supplement to the Statute Book No. 3041) as has already been amended by Law No. 43/1999 (Statute Book of the Republic of Indonesia Year 1999 No. 169, Supplement to the Statute Book No. 3890);
- 2. Government Regulation No. 30/1980 concerning Regulation of Civil Government Employee Discipline (Statute Book of the Republic of Indonesia Year 1980 No. 50; Supplement to Statute Book No. 3176);
- 3. Government Regulation No. 9/2003 concerning Right for Hire, Move, and dismissal of Civil Government Employee (Statute Book of the Republic of Indonesia Year 2003 No. 15, Supplement to Statute Book No. 4263);
- 4. Government Regulation No. 42/2004 concerning Keeping Corps Spirit and Ethic Code of Civil Government Employee (Statute Book of the Republic of Indonesia Year 2004 No. 142, Supplement to Statute Book No. 4450);
- 5. Regulation of the Minister of Finance No. 15/KMK.01/UP.6/1985 concerning Provision of Making Working Discipline in Relation with Giving Special Allowance of State Financial Construction to Employee in Ministry of Finance of the Republic Indonesia;
- 6. Regulation of the Minister of Finance No. 2/KM.1/2003 concerning Technical Direction for Implementation Increasing Working Efficiency and Discipline of State Employee in Ministry of Finance;
- 7. Regulation of the Minister of Finance No. 30/KMK.01/2007 concerning Reformation of Bureaucracy in Ministry of Finance;
HAS DECIDED:
To stipulate:
REGULATION OF THE MINISTER OF FINANCE CONCERNING DIRECTION TO INCREASE DISCIPLINE OF CIVIL GOVERNMENT EMPLOYEE IN MINISTRY OF FINANCE
Article 1
In this Regulation of the Minister of Finance, the meaning of:
- 1. Civil Government Employee referred to Candidate of Civil Government Employee and Civil Government Employee of the Ministry of Finance as described in Law No. 8/1974 concerning Principles of Employee Affair as has already been amended by Law No. 43/1999.
- 2. Ethic Code of Civil Government Employee hereinafter called Ethic Code is direction for attitude, behavior and action of Civil Government Employee in doing basic and functional task and in daily society of every unit of Echelon I.
- 3. Ethic Code Council of Civil Government Employee hereinafter called Ethic Code Council is non structural agency which has task to give sanction of implementation and the settlement of the violation of Ethic Code of Civil Government Employee.
- 4. Collision referred to all kind of oral, written and action of Civil Government Employee which in opposite with Ethic Code.
- 5. Authorized Official referred to Minister of Finance or appointed official.
Article 2
(1) Every unit in Echelon I of Ministry of Finance should make Ethic Code.
(2) Leader of Echelon I unit on behalf of Minister of Finance make Ethic Code and control implementation of Ethic Code.
(3) Using basic principles inconstructing the Ethic Code, as follows:
- a. does not contradict the regulation about Ethic Code of Civil Government Employee;
- b. arranged in easy language that is easy to be understood and remembered; and
- c. described according to the condition and characteristic of each Echelon I unit.
Article 3
Ethic Code shall have following:
- a. purpose;
- b. obligations and prohibitions; and
- c. sanctions.
Article 4
The purpose covers:
- a. increase discipline of Civil Government Employee;
- b. maintain the disciplinary;
- c. guarantee the smooth implementation of task and conducive working condition;
- d. create and maintan the professional working condition; and
- e. increase image and performance of Civil Government Employee.
Article 5
(1) The obligations covers:
- a. Obedience to regulation about task implementation of Echelon I unit;
- b. Obedience to discipline about starting time, rest time, ending time and use working hour according to the stipulated regulation.
- c. Relation among Civil Government Employees vertically or horizontally;
- d. Relation among Civil Government Employee with parties which has interest in task; and
- e. Politeness in appearance and spoken language.
(2) Prohibitions Covers:
- a. prohibition to be discriminative in conducting duties;
- b. prohibition on becoming active members or fans of any political party;
- c. prohibition in misuse of rights;
- d. prohibition to receive gift in relation with position and rights;
- e. prohibition in leaking the confidential information;
- f. prohibition in conducting immoral actions that contradicts the norms; and
- g. prohibition to do actions which tarnish the Ministry of Finance.
Article 6
(1) Civil Government Employee shall obey and follow Ethic Code.
(2) Civil Government Employee who committ violation in Ethic Code will get sanctions.
Article 7
Sanctions as intended in Article 6 paragraph (2) are:
- a. moral sanction; and/or
- b. discipline sanction or other administrative sanction based on recommendation from Ethic Code Council.
Article 8
(1) Authorized official serves moral sanction as intended in Article 7 sub-paragraph a in writing and with confidentiality.
(2) In giving moral sanction as intended in Article 7 sub-paragraph a, should describe kind of collision of Ethic Code done by Civil Government Employee.
(3) Giving discipline sanction or administration sanction as described in Article 7 sub-paragraph b follow provision in Government Regulation No. 30/1980.
Article 9
(1) Ethic Code Council is established in Ministry of Finance and in unit of Echelon I.
(2) Establishment of Ethic Code Council will be stipulated further in Regulation of the Minister of Finance.
Article 10
(1) Latest arrangement of Ethic Code for unit of Echelon I as intended in this Regulation of the Minister of Finance is stipulated by the latest in June 2007.
(2) Present and effective Ethic Code in unit of Echelon I in Ministry of Finance should be matched with this Regulation of the Minister of Finance, by the latest is on June 2007.
(3) Every unit should make Ethic Code as intended in paragraph (1) and (2) in pocket book to be distributed to all Civil Government Employee.
Article 11
Implementation of Article 5 paragraph (1) sub-paragraph b use electronic attendance system which procurement system depends on budget ability of each unit of Echelon I.
Article 12
This Regulation of the Minister of Finance shall come into effect at the date of stipulation.
For public cognizance, this Regulation shall be published in the State Gazette of the Republic of Indonesia.
